Donor Reward Store Terms and Conditions

    1. Introduction

    Welcome to Our Blood Institute's ("OBI") Donor Reward Store which allows participation in the Donor Rewards Program. By accessing and using the Donor Reward Store, you agree to be bound by these Terms and Conditions ("Terms"). The Donor Reward Store allows blood donors to accumulate points that may be redeemed for various products and services. Participation in this program is subject to these Terms, which may be updated or modified at OBI’s sole discretion without prior notice. Any continued participation in the Donor Reward Store following such modifications constitutes acceptance of the revised terms.

    2. Eligibility

    Participation in the Donor Reward Store is limited to individuals who (1) are at least 18 years of age, (2) are legal residents of the United States of America, and (3) have donated transfusable blood components with OBI, have logged into their donor portal, and have accrued points through the Donor Rewards Program.

    Points are provided based on donation frequency, timing and other conditions and/or qualifying activities as determined by OBI and noted in various updates we provide to you about the Donor Rewards Program and/or are made available where you log-in to review your accumulated points. These points are personal to the donor, non-transferable, and have no monetary or cash value. OBI reserves the right to verify eligibility and to revoke or adjust points at any time if fraud, misuse, or error is suspected. Additionally, donors who remain inactive for a period of one (1) year will permanently forfeit any accumulated points.

    3. Reward Points

    Donors can redeem points for a variety of products and services offered through the Donor Reward Store. These offerings include, but are not limited to, non-transferable gift cards, promotional items and blood testing services such as LIPID and PSA blood testing. The availability of products and services is subject to change, and OBI reserves the right to substitute or remove goods or services from being redeemable for points, as OBI sees fit and in its sole discretion.

    All redemptions made through the Donor Reward Store are considered final once an order has been submitted by you, the donor. Once an order is submitted, donors cannot modify or cancel their selection. OBI does not guarantee that reward items will always be available, as inventory levels fluctuate based on demand. If an item is out of stock, OBI may offer an alternative item or refund points to the donor’s account at its sole discretion. Points will be deducted immediately upon confirmation of an order.

    Redemptions for points (whether goods or services) are non-transferable, cannot be sold or gifted, may not be redeemed for cash, and will not be replaced if lost or stolen. There is no cash equivalent for anything offered through the Donor Reward Store. Each redeemable good or service consists only of the elements expressly set forth in its item description. Any other expense, fee, and/or incidental costs are not included for which you, the donor, is liable and responsible.

    Note: Mission Market gift cards must be redeemed within six (6) months of issuance. After that date, any unused balance will expire.

    4. Fulfillment

    Fulfillment of orders generally takes between four (4) to six (6) weeks from the date of purchase, though actual delivery times may vary based on supplier constraints, shipping provider delays, or other logistical issues beyond OBI’s control.

    For gift cards and electronic rewards, delivery will typically be made via email to the email address associated with the donor’s account. Donors are responsible for ensuring that their contact information is accurate and up to date. OBI is not responsible for undelivered electronic rewards due to incorrect or outdated contact details. Physical items will be shipped to the mailing address on file, and donors should ensure that their shipping information is correct before finalizing a redemption.

    Once an order is shipped, OBI is not responsible for any delays, loss, or damage incurred during transit. Shipping carriers may require additional time for delivery due to unforeseen circumstances, and OBI does not guarantee specific delivery dates. Donors should contact OBI's customer support for assistance if an order does not arrive within the expected timeframe.

    5. Returns & Reimbursement

    Certain items are returnable and, if so, will be noted as such in the Donor Rewards Store. Donors who wish to return such an item must do so within ninety (90) days of the original purchase date and only items in their original condition, unused, and accompanied by any originally-included packaging and documentation shall be eligible for return. Certain items, including but not limited to gift cards and blood testing services, may not be eligible for return under any circumstances.

    If a donor chooses to return an item, OBI will assess the condition of the returned product and, if deemed acceptable, may either replace the item with a comparable product or reimburse the donor by restoring the equivalent number of points to their account. The decision to offer a replacement or a points reimbursement will be at OBI’s sole discretion. Donors must contact OBI’s customer support team prior to returning an item to receive return instructions. Unauthorized returns may not be accepted.

    OBI is not responsible for return shipping costs unless the return is due to an error on OBI’s part, such as a defective or incorrect item being sent. If a returned item is lost or damaged during the return process, OBI reserves the right to deny reimbursement.

    6. Limitation of Liability and Disclaimers

    OBI is not responsible for any lost, stolen, or damaged items once they have been shipped. Donors and participants in the Donor Rewards Program assume all risk associated with the receipt and use of any items or services provided through the Donor Rewards Store. OBI makes no warranties, express or implied, regarding the merchantability, fitness for a particular purpose, or suitability of such goods or services. OBI is not responsible for third-party fulfillment providers, manufacturers, or retailers of products provided through the Donor Reward Store. Any claims, issues or complaints (whether related to warranty or other issues) regarding any such item should be addressed directly with the manufacturer or provider, as applicable.

    By participating in the Donor Rewards Program and using the Donor Rewards Store you agree to: (a) comply with and be bound by Terms; (b) release and hold harmless OBI and its parent, subsidiary, and affiliated companies and all of their respective past and present officers, directors, owners employees, agents and representatives (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability for any reason under any theory, whether arising under contract, statute or tort (including but not limited to negligence) and damages of any kind to persons and property or death or personal injury) arising out of or relating to participation in the Donor Rewards Program or acceptance, declination, use and/or misuse of anything obtained or offered through the Donor Rewards Store thereto), and (c) indemnify, defend and hold harmless the Released Parties from and against any and all claims, expenses, and liabilities (including reasonable attorneys’ fees) arising out of or relating to your participation in the Donor Rewards Program and use of the Donor Rewards Program (including acceptance, use, inability to use or misuse of a service or item obtained or offered through the Donor Rewards Store).

    THE DONOR REWARDS STORE, DONOR REWARDS PROGRAM, THEIR RESPECTIVE CONTENT AND INFORMATION OBTAINED THROUGH THIS SITE ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WITHOUT LIMITING THE FOREGOING, NEITHER OBI NOR ANY OF THE RELEASED PARTIES REPRESENTS OR WARRANTS THAT THE DONOR REWARDS STORE OR ITS CONTENT OR INFORMATION WILL BE ACCURATE, RELIABLE, ERROR-FREE OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT THE DONOR REWARDS STORE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS OR WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS. EACH OF THE RELEASED PARTIES HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT AND FITNESS FOR PARTICULAR PURPOSE. THE FOREGOING DOES NOT AFFECT ANY WARRANTIES WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

    IN NO EVENT WILL ANY OF THE RELEASED PARTIES BE LIABLE FOR DAMAGES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE DONOR REWARDS STORE OR DONOR REWARDS PROGRAM OR ANY CONTENT OR INFORMATION OFFERED ON OR THROUGH EITHER OF THEM (INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, REGARDLESS OF THE NATURE AND INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA) UNDER ANY LEGAL THEORY AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT OR OTHERWISE, EVEN IF FORESEEABLE. THE FOREGOING DOES NOT AFFECT ANY LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

    7. Fraud & Abuse

    OBI reserves the right to investigate any suspected fraudulent or abusive activity related to the Donor Reward Store. This includes, but is not limited to, unauthorized account access, point manipulation, fraudulent redemptions, or misrepresentation of donor status. Any attempt to abuse the reward system may result in the forfeiture of accrued points, the suspension or termination of participation in the Donor Reward Store, and potential legal action.

    OBI regularly audits donor accounts and reward transactions to ensure compliance with these Terms. If a donor is found or believed to have violated the Terms, OBI may take corrective action, including but not limited to removing points, canceling redemptions, or permanently banning from future participation in the Donor Rewards Program.

    8. Changes & Termination

    OBI reserves the right to modify, suspend, or terminate the Donor Reward Program or Donor Reward Store at any time without prior notice. In the event of termination, donors may forfeit any remaining points in their account. OBI is not obligated to provide compensation for unused points or unfulfilled reward redemptions.

    If the Donor Rewards Program or Donor Rewards Store is suspended or discontinued, OBI may provide notice through its website, donor communications, or other means. It is the responsibility of donors to stay informed of any program changes.

    9. Collection and Use of Personal Information

    What We Collect and How We Use it.

    We may collect certain personal information to process your requests through the Donor Rewards Store. The personal information we collect may include the following:

    • Your Contact Information. This includes information such as a name, alias, address, phone number, social media account user ID, email address, and similar contact data should you provide that information.
    • Device Information. This refers to device and browser information, such as network and connection information (including Internet Service Provider (ISP) and Internet Protocol (IP) addresses), device and browser identifiers and information (including device, application, or browser type, version, plug-in type and version, operating system, user agent, language and time zone settings, and other technical information), advertising identifiers, cookie identifiers and information, and similar data.
    • Usage Data. This refers to data collected automatically, whether generated by your use of the Donor Rewards Store or as a result of site infrastructure itself (for example, the duration of a page visit). This includes usage metrics, content interactions (including searches, views, downloads, prints, shares, streams, and display or playback details), and user history (including clickstreams and page navigation), content viewed or searched for, page response times, page interaction information, advertising interactions and marketing preferences.

    We process personal information in connection with the Donor Rewards Store and for other business purposes as follows:

    • Fulfillment of your requests.
    • To provide, deliver, analyze, and administer the Donor Rewards Store and related services.
    • For that which you have given us consent to process your personal information for specified purposes.
    • For internal research and development purposes for new content, products, and services, and to improve, test, and enhance the features and functions of the Donor Rewards Store.
    • Personalize and make recommendations related to the Donor Rewards Store and other offerings.
    • Contact and communicate with you in connection with the Donor Rewards Store or other notifications or communications you have requested from us.
    • Detect and prevent fraud and abuse, as well as to identify and authenticate your access to the Donor Rewards Store or to identify and authenticate you before we provide you with certain information, goods or services.
    • Exercise our rights and to protect our and others’ rights and/or property.
    • To provide you with notice regarding a security incident, by: (i) sending a message to the email address you provide (as applicable); (ii) posting to a publicly facing page of our website; (iii) through major statewide media; and/or (iv) telephonic means, including calls and/or text messages, even if sent via automated means including automated dialers (standard text and data messaging rates may apply from your carrier). Notices sent by e-mail will be effective when we send the email, notices we provide by posting will be effective upon posting, and notices we provide through telephonic means will be effective when transmitted or dialed. You consent to receiving electronic communications from us relating to any security incident or data breach. It is your responsibility to keep your email address and any other contact information you provide to us current so that we may provide these communications to you.
    • We may use your information to contact you about product and service offerings by email or otherwise. You have the right to opt-out of such messages. We may use your information to investigate, respond to and/or resolve legal, security or technical issues and complaints and as necessary for security purposes or to investigate possible fraud, violations of law or violations of these Terms. We may use your information to contact you about these security, legal and other service-related issues. Please be aware that you cannot opt-out of receiving such messages from us.

    By using the Donor Rewards Store without changing your browser or device settings to disable cookies, you agree to our use of cookies. Cookies are small data files stored on your computer or other device when websites are loaded in a browser. They are used to remember you and your preferences through either a single visit to a Site (a “session cookie”) or over the course of repeated visits (a “persistent cookie”). Cookies help to facilitate the best possible user experience as they allow us to recognize your preferences and information from session to session and generally improve website functionality.

    We use cookies for several different purposes. We use cookies for technical reasons, to recognize you and/or your device(s) on, off, and across the different applications of the website and devices and we log usage data when you use the Donor Rewards Store, including when you view or click on content, browser type, browser language, perform a search or request, the date and time of your request or use one or more tools offered through the website. We use log-ins, device information internet protocol (“IP”) addresses, and cookies to identify you and log your use. When you access or leave the Donor Rewards Store, we receive the URL of both the site you came from and the one you go to next. We may also get information about your IP address, proxy server, operating system, web browser and add-ons, device identifier and features, and/or ISP or your mobile carrier. We do not collect information concerning your GPS location

    Although most internet browsers accept cookies, you can control these types of technology through your browser settings and similar tools and agree to refuse cookies altogether. If you refuse to accept cookies by activating the appropriate setting on your browser or smartphone, you prohibit us from delivering the full capability of the website and prevent the use of certain features and services that require these technologies.

    What we disclose and to whom.

    We may disclose information that we collect or that you provide to fulfill our obligations to you (if any), the purpose for which you provide it (if any), for any other purpose for which we have your consent, or for legitimate business purposes which may include where required by law, subpoena, or other legal process or as necessary in the course of legal proceedings. We will share your personal data internally to help facilitate your requests and provide information to you.

    We may disclose personal information that we collect or you provide to service providers and other third parties we use solely to support our business (such as the management and maintenance of the Donor Rewards Store, services related to fulfillment of your requests and the like. They will have access to your information only as reasonably necessary to perform these tasks on our behalf and are obligated not to disclose or use it for other purposes.

    We may transfer your personal information to third parties if we reasonably believe that disclosure of such information is helpful or reasonably necessary to comply with any applicable law or regulation, to comply with or respond to a legal process or law enforcement or governmental request, to enforce our terms and conditions or other rights (including investigations of potential violations of our rights), to detect, prevent, or address fraud or security issues, or to protect against harm to the rights, property, or safety of our company, our users, or the public.

    Your Requests.

    For personal data that we have about you, you may make requests such as the following:

    • Deletion: You may ask us to erase or delete all or some of your personal data. Doing so may limit your ability to use certain functionality of the Donor Rewards Store as well as our ability to process your requests and inquiries.
    • Correction/Modification: You may ask us to change, update, or fix your data in certain cases, including if it’s inaccurate.
    • Object to, or Limit or Restrict, Use of Data: You may ask us to stop using all or some of your personal data or to limit our use of it; however, doing so may limit your ability to use certain functionality of the Donor Rewards Store as well as our ability to process your requests and inquiries.
    • Right to Access Your Data: You can ask us for a copy of your personal data you have provided to us so long as we are able to verify your identity when you make such a request.

    To make a request or inquiry concerning your personal information, contact us at the information above and include the phrase “[Your State] Privacy Request” in the subject line. When you make a request, we ask that you help us by also identifying the following:

    • Tell Us Your Specific Request: Please specify your specific request and the personal information to which your request relates. If you are acting on behalf of another individual, please clearly indicate this fact and your authority to act on such person’s behalf.
    • Help Us Verify Your Identity: Provide us enough information to verify your identify. Please note that if we cannot verify your identity, we may not be able to fulfill your request. If you prefer to receive our response in another way, then please let us know your preferred delivery mechanism to receive our response. You may specify, for example, email, mail, or through your account (if you have one with us).

    We may decline to process requests if we cannot verify the requestor’s identity, if we believe the request will jeopardize the privacy of others, if we believe the change would violate any law or legal requirement or cause the information to be incorrect, or for a similar legitimate purpose. In any case, where we provide information access, deletion or correction, we perform this service free of charge, except if doing so would require a disproportionate effort.

    We will not discriminate against you for exercising any of your rights under applicable law. We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

    10. Security and Protection

    We implement industry standard security safeguards designed to protect your data. These include using encryption for your data while it is being transmitted between your device or browser and our servers. Nevertheless, given the nature of communications and information technology, and that the use of the internet has inherent risks, although we regularly monitor for possible vulnerabilities and attack, we cannot warrant or guarantee that information provided to us through the Donor Rewards Store or stored in our systems or otherwise will be absolutely free from unauthorized intrusion by others. By using the Donor Rewards Store, you agree that we are not responsible for: (i) any disclosure of your personal information made by you to a third party through your use; (ii) any disclosure of your personal information obtained illegally from us; or (iii) any accidental disclosure of your personal information made by us.

    11. Authorized and Prohibited Uses

    You may use the Donor Rewards Store only for lawful purposes and in accordance with these Terms. You agree not to: (i) use the Donor Rewards Store in any way that violates applicable law or the rights of any third party; (ii) any robot, spider or other automatic device, process or means to access the Donor Rewards Store for any purpose, including monitoring or copying any of the material on the Donor Rewards Store; (iv) use any manual process to monitor or copy any of the material on the Donor Rewards Store or for any other unauthorized purpose without our prior written consent; (v) use any device, software or routine that interferes with the proper working of the Donor Rewards Store, introduce any malicious code or otherwise attempt to interfere with the proper working of the Donor Rewards Store; or (v) use any part of the Donor Rewards Store for any competing commercial purposes, commercial purposes not pre-approved by OBI, or in a manner that is likely to give the impression that information or content of yours emanates from or is endorsed by OBI if this is not the case. Any use of the Donor Rewards Store not expressly permitted by these Terms is a breach of these Terms and may violate copyright, trademark and other laws. If you feel that any content, material, name or logo used on the Donor Rewards Store violates your intellectual property rights, please contact us.

    12. Miscellaneous

    These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Oklahoma, without regard to any conflict of law principles. Any and all disputes, claims and causes of action arising out of or connected with the Donor Rewards Program or Donor Rewards Store shall be resolved individually without resort to any form of class action and the exclusive venue for the same shall be in the federal or state courts sitting in Oklahoma County, Oklahoma..

    These Terms constitute the sole and entire agreement between you and OBI with respect to the Donor Rewards Store and supersede all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral. If any portion of these Terms is held to be invalid, illegal or unenforceable for any reason, that provision shall be eliminated or limited to the minimum extent and the remaining terms will continue in full force and effect.
